These Terms and Conditions, together with any other documents referred to herein, set out the terms and conditions for the use of this website www.semleaders.com (‘Site’).  Please read these Terms and Conditions carefully and ensure that you understand them. Your agreement to abide by and be bound by these Terms and Conditions shall be deemed to have occurred when you first use our Site. If you do not agree to be bound by these Terms, you must stop using our Site immediately.

I. General Provisions 

These Terms of Service constitute the terms and conditions as defined in Article 8 of the Act of July 18, 2002, on the provision of electronic services. 

The Terms of Service specify the types and scope of services provided electronically via the Website, the rules for providing these services, the conditions for concluding and terminating agreements, and the complaint procedure. 

The technical requirements necessary to use the Service Provider’s teleinformation system include: (1) a computer, laptop, or other multimedia device with Internet access; (2) access to email; (3) a web browser. 

The Terms of Service define the principles of operation and use of the Website, as well as the rights and obligations of the Service Recipients and the Service Provider related to the use of the Website. 

II. Definitions

Website – the Service Provider’s website available at: www.semleaders.com

 Terms of Service – these terms and conditions of the Website. 

Electronic Service – a service provided electronically by the Service Provider to the Service Recipient via the Website.

Service Recipient – (1) a natural person; (2) a legal person; or (3) an organizational unit without legal personality, which the law grants legal capacity, using or intending to use the Electronic Service. 

Materials – free digital content in the form of articles and webinars. 

Newsletter – an electronic service provided via email, allowing Service Recipients to automatically receive periodic messages from the Service Provider with information about Materials, news, and promotions on the Website. 

Contact Form – an electronic service in the form of an interactive form available on the Website, enabling contact with the Service Provider. 

Consumer – a natural person entering into a legal transaction with a business not directly related to their business or professional activity, or a natural person entering into an agreement directly related to their business activity, where the content of this agreement indicates that it does not have a professional character for them. 

Electronic Communication – communication between the parties via email and contact forms available on the website www.semleaders.com.

III. Electronic Services on the Website 

The following Electronic Services are available on the Website: Contact Forms, Newsletter, and Materials. 

Using the Contact Form begins when the Service Recipient provides their first name, last name, company name, position, phone number, email address, and message content, checks the box accepting the Terms of Service and Privacy Policy, and then clicks the „Send” button. 

The Contact Form service is free and one-time – it ends when the message is sent via the form or when the Service Recipient stops entering data. 

The Newsletter service is provided free of charge for an indefinite period. The Service Recipient can unsubscribe from the Newsletter at any time by sending a request to: info@semleaders.com. 

Some Materials are publicly available to users of the Website. The Materials service is free and provided for an indefinite period. 

IV. Terms of Use of the Website 

Using the Website by Service Recipients is free of charge and voluntary. 

Service Recipients are required to familiarize themselves with the Terms of Service and documents constituting its integral part and must accept its provisions to use the Website. 

Service Recipients may not use personal data obtained from the Website for marketing purposes. 

Technical requirements for using the Website: 

  1. a) a device with a display that enables viewing web pages, 
  2. b) an internet connection, 
  3. c) a web browser compliant with W3C standards and supporting HTML5, 
  4. d) JavaScript enabled, 
  5. e) Cookies enabled. 

Service Recipients should adhere to generally accepted network security principles to ensure the safety of all users of the Website. 

The following actions are prohibited: 

  1. a) decompiling and analyzing the source code without written consent, 
  2. b) actions causing excessive load on the Website server without consent, 
  3. c) attempts to detect vulnerabilities in the Website’s security without consent, 
  4. d) uploading or injecting malicious code, scripts, and software, 
  5. e) actions aimed at damaging, blocking the operation of the Website, or preventing the Website from achieving its purpose. 

In case of detecting a cybersecurity incident or GDPR violation, Service Recipients should promptly report it to the Service Provider. 

V. Registration Terms Service 

Recipients can use the Website without registration. 

Registration is necessary to use additional services available after logging in. 

Registration on the Website is voluntary and free of charge. 

Each Service Recipient can have only one account on the Website. 

Technical requirements for account registration: 

  1. a) having an individual email account. 

Registered Service Recipients consent to the processing of personal data in accordance with the Privacy Policy. 

The Service Provider has the right to suspend or delete accounts of Service Recipients violating the Terms of Service, legal regulations, social norms, or acting to the detriment of other users. 

The services of the Website may be changed, added, subtracted, or temporarily suspended at the discretion of the Service Provider. 

Registered Service Recipients must not share their login and password with third parties. 

The Service Provider does not request the user account password. 

VI. Newsletter Service Terms 

Service Recipients can use the Website without subscribing to the Newsletter. 

Subscribing to the Newsletter is voluntary and free of charge. 

Technical requirements related to the Newsletter service: 

  1. a) having an individual email account. 

Terms of the Newsletter service:

  1. a) providing an email address in the form,
  2. b) verifying the email address, 
  3. c) consenting to receive email notifications. 

Scope of the Newsletter service: 

  1. a) notifications about new updates, posts, contests, and other promotional activities, 
  2. b) notifications about promotional activities of the Website’s partners. 

The Service Recipient can unsubscribe from the Newsletter at any time via the link in the email message. 

VII. Terms of Communication and Provision of Other Services on the Website 

The Website provides services and tools enabling interaction with the Website: 

  1. a) Contact Form, 
  2. b) Commenting on posts and articles. 

The Website provides contact details in the form of: 

  1. a) email address, 
  2. b) contact phone number. 

In case of contact between the Service Recipient and the Service Provider, personal data will be processed in accordance with the Privacy Policy. 

Terms for posting content by Service Recipients on the Website: 

  1. a) prohibition of posting offensive, defamatory, vulgar, pornographic, and illegal content, 
  2. b) prohibition of posting materials without the author’s license or consent,
  3. c) prohibition of posting scripts, programs that excessively burden the server, and illegal software, 
  4. d) prohibition of posting marketing and advertising content of other commercial services.

VIII. Collection of Data on Service Recipients 

In order to properly provide services, secure the legal interest of the Service Provider, and ensure compliance with the law, the Service Provider collects and processes data about Users. 

The Website uses and stores anonymous information about the Service Recipient in cookies. 

The scope, purposes, method, and principles of data processing are available in the attachments to the Terms of Service: „GDPR Information Obligation” and in the „Privacy Policy.” 

Data collected automatically:

  2. b) browser type, 
  3. c) screen resolution, 
  4. d) approximate location, 
  5. e) opened subpages of the website, 
  6. f) time spent on a subpage, 
  7. g) type of operating system, 
  8. h) address of the previous subpage,

  10. j) browser language, 
  11. k) internet connection speed, 
  12. l) internet service provider, 
  13. m) demographic data (gender, age, interests). 

Data collected during registration:

  3. c) email address. 

Data collected when subscribing to the Newsletter:

IX. Copyrights

The owner of the Website and the copyrights to the Website is the Service Provider. 

Some data on the Website is protected by copyrights belonging to companies, institutions, and third parties, used under license or free license. 

It is prohibited to use, copy, reproduce, and store content from the Website without the consent of the copyright owner. 

Simple press information is not protected by copyright and can be used, but copying whole or parts of articles is prohibited. 

X. Changes to the Terms of Service 

The Service Provider may unilaterally change the Terms of Service without giving reasons. 

Information about the change to the Terms of Service will be sent electronically to registered Service Recipients. 

Changes to the Terms of Service take effect immediately upon publication for Service Recipients without an account. 

For registered Service Recipients, changes take effect 7 days after publication.

 Continuing to use the Website after the changes to the Terms of Service means acceptance of the changes. 

XI. Final Provisions 

The Service Provider is not responsible for the content transmitted and published on the Website by Service Recipients. 

The Service Provider makes every effort to ensure that the services of the Website are offered continuously, but is not responsible for disruptions caused by force majeure, interference by Service Recipients, third parties, or external programs. 

The Service Provider reserves the right to change information posted on the Website without prior notice. 

The Service Provider reserves the right to temporarily or permanently disable the Website for improvement, adding services, or maintenance. 

The Service Provider reserves the right to permanently shut down the Website without prior notice. 

The Service Provider reserves the right to transfer rights and obligations related to the Website without the consent of the Service Recipients.
